Your accessibility gaps haven't.

Some deadlines have shifted. Others are already here. Public organizations that act now — regardless of which mandate applies — are ahead of litigation risk, funding requirements, and the pressure of a last-minute scramble.

Frequently asked questions

Are government websites required to be accessible?

Yes. Federal law requires government websites to be accessible to people with disabilities. The Americans with Disabilities Act (ADA) applies to state and local government digital services, and Section 508 of the Rehabilitation Act applies to federal agencies and those receiving federal funding. In 2024, the Department of Justice (DOJ) issued a final rule under ADA Title II, setting specific deadlines for state and local governments to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA.

WCAG — the Web Content Accessibility Guidelines — is the internationally recognized standard for web accessibility. While WCAG is not a law itself, U.S. courts and federal agencies, including the DOJ, consistently reference WCAG as the benchmark websites should conform to in order to comply with the ADA. For government agencies, conforming to WCAG 2.1 Level AA is now a legal requirement under the new ADA Title II rule.

The DOJ’s final rule sets a phased timeline based on population size. Agencies serving populations of 50,000 or more have an earlier deadline, while smaller agencies have additional time. All state and local government entities covered by Title II are expected to conform to WCAG 2.1 Level AA by their applicable deadline. accessiBe can help your agency assess where you stand and take the right next steps.

Section 508 applies to federal agencies and organizations that receive federal funding — it requires that their information and communication technology, including websites, be accessible. ADA Title II applies more broadly to all state and local government entities and prohibits discrimination on the basis of disability in public services, including digital ones. Many government organizations are subject to both.
