Are government websites required to be accessible?
Yes. Federal law requires government websites to be accessible to people with disabilities. The Americans with Disabilities Act (ADA) applies to state and local government digital services, and Section 508 of the Rehabilitation Act applies to federal agencies and those receiving federal funding. In 2024, the Department of Justice (DOJ) issued a final rule under ADA Title II, setting specific deadlines for state and local governments to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA.
What is WCAG and why does it matter for government sites?
WCAG — the Web Content Accessibility Guidelines — is the internationally recognized standard for web accessibility. While WCAG is not a law itself, U.S. courts and federal agencies, including the DOJ, consistently reference WCAG as the benchmark websites should conform to in order to comply with the ADA. For government agencies, conforming to WCAG 2.1 Level AA is now a legal requirement under the new ADA Title II rule.
What are the DOJ deadlines for ADA Title II compliance?
The DOJ’s final rule sets a phased timeline based on population size. Agencies serving populations of 50,000 or more have an earlier deadline, while smaller agencies have additional time.
